Fact Patterns
Fact Pattern 1
In criminal court, Judge Lee presides over a burglary case with two defendants. Both defendants are accused of first-degree burglary and both have previous felony criminal convictions. After reviewing the pre-sentencing report, Judge Lee sentences the younger of the two defendants, a 20-year-old male without a violent felony, to a facility that provides drug intervention, counseling, and vocational training. Judge Lee sentences the older male, 44 years old with a history of violence, to a longer prison term in a state prison that doesn’t provide all of the same treatment and educational options.
Fact Pattern 2
Probation Officer (PO) Holmes is responsible for supervising a local restaurant owner placed on probation for driving while intoxicated. According to the sentencing order of the court, the restaurant owner must refrain from visiting any place that serves alcohol, including his own restaurant. PO Holmes visits the restaurant at least twice a week where the owner personally seats him and serves him dinner. PO Holmes doesn’t file any violation of probation charges against the owner.
Fact Pattern 3
Police Officer Jones pulls over a vehicle driven by a 25-year-old female, Nancy Martin. When Martin was recorded driving three miles over the speed limit, she had her sick mother in the car. Martin had previously met Officer Jones, as he’s a community liaison. Martin told the officer she’s taking her mother to the doctor and didn’t think about the speed limit because she was worried. Officer Jones doesn’t cite Martin, despite her previous history of speeding tickets.
